Origin of Hess Cemetery, Johnson County, Arkansas, by Cindy Barnett

George Washington Hess, my great-grandfather, was born in June of 1827 in Ohio. A widower with four children in the early 1870s, he decided after a few years to go to Arkansas with three of his four children, Elizabeth, Michael and Perry – Jane stayed and married in Ohio, where she lived her lifetime. In 1862, the U.S. government had passed the Homestead Act, which entitled virtually anyone over the age of 21 to claim a 160-acre parcel of land. Farmers, miners, trappers, rangers and adventurers took advantage of the offer; they had five years to farm, build a home, and improve the land for a mere $18 filing fee.

George married a second time to Sarah Ann Evans, and two children were born of this marriage, Will and Thomas Clayton, my grandfather. These two boys farmed the land with their father, along with son-in-law David Evans and sons Michael and Perry from his first marriage - they all lived on the land for a period of time, even when the children married and had families of their own. There was plenty of room on this beautiful property, with its gently rolling hills and fertile land.

The first tax receipt I have is when George paid his taxes in 1879 for the 160 acres that he claimed in the Homestead Act. The land the Hess Cemetery sits on today is a portion of that original 160 acres that he homesteaded and farmed. The total amount of taxes in 1879 was $5.65, and the total valuation of the land was $104.00. Around 1889, George sold 80 acres; that same year he deeded the land to his wife, Sarah and her heirs. The last time he paid the taxes was in 1905, as George died that year. At that point, his son Will took over payment of the taxes on the land up until 1914, when my grandfather, Thomas Clayton, purchased Will’s part of the land and started paying the taxes on it. Times were hard, and getting ready to get harder in the Depression; around 1918, my grandfather sold 40 of the 80 acres to pay taxes. Clayton’s brother Will died of pneumonia in 1919 at the age of 36.

In 1932, the land was forfeited for non-payment of taxes due of $41.00; on December 31, 1932, Clayton made the tax payment and the land was then his again. In 1939, Clayton sold the land and purchased five acres on Highway 64 in Coal Hill, where he and his family together built the rock house that still stands, and where his descendants lived until the death of his son, Troy Lee, in 2006. My grandfather Clayton and his son Troy Lee maintained and kept the cemetery for many, many years. I have all of my grandfather’s original records of payments on burial plots from different folks in the surrounding community throughout the years.

The first person to be buried in the Hess Cemetery was Meriam Hess, baby daughter of Michael Hess, George’s son from his first marriage, and Nan Griffith. Meriam was born February 10, 1890 and died on February 25, 1890. The second burial is that of an ex-Civil war soldier, who was traveling through Arkansas, and very ill. Although the Hess family took him in and tried to nurse him back to health, he died, and George and his family buried him nearby the grave of their little granddaughter, Meriam. This was the beginning of many Hess descendants, their expanded relatives, and friends in the surrounding community to make this beautiful spot their final resting place. In 1970, when I was a senior in high school, I came to take my pictures of the newly-constructed gate at the cemetery for my grandfather Clayton. He was so very proud of this gate and his family’s name on it, which eternally marks the legacy of his grandfather’s dream of owning his own land in the beautiful hills of Arkansas.
